A senior functionary of the Guyana Elections commission has sued publisher of the Kaieteur News Glenn Lall and its columnist Freddie Kissoon, alleging that she was defamed in an article published on 25th of January 2021.
Deputy chief elections officer Roxanne Myers in court documents seen by the Guyana Daily said that the article ‘ Jimmy James, Roxanne Myers and the absurd existence of Guyana’ falsely and maliciously published several statements. Myers, in suing for more than GUY $70 million has argued that the words published were ‘untrue malicious and penned in undiluted falsehood.’
Myers in the court documents denied acting ultra vires in her capacity as Deputy chief elections officers as it relates to the March 2nd, 2020, General and Regional elections.
‘The allegations levelled against Myers have substantially hurt and diminished her image in the eyes and minds of the Guyanese public’ the lawsuit states.
In February of 2021 Senior Magistrate, Leron Daly ruled that the two counts of misconduct in public office charges against Deputy Chief Elections Officer, Roxanne Myers are to remain indictable.
Magistrate Daly upheld a submission made by Myers’ attorney, Nigel Hughes who wanted the charges to remain indictable. This means that the magistrate will conduct a Preliminary Inquiry to determine if there is enough evidence for Myers to stand trial at the High Court.
On October 9, 2020, DCEO Myers was arraigned on the two alleged offences and was released on $300,000 bail. Myers was arrested on October 6, 2020, after she turned herself in at the Criminal Investigations Department (CID) Headquarters, Eve Leary, Georgetown, in the company of her attorneys.
The charges against Myers was that between March 4 and March14, 2020, in Georgetown, while being a public officer, that is to say the Deputy Chief Elections Officer of the Guyana Elections Commission, she wilfully misconducted herself, together with Clairmont Mingo and others, to declare a fraudulent account of votes for the General and Regional Elections, which amounted to a breach of the public’s trust in the office of the said DCEO of the Guyana Elections Commission, without any reasonable excuse or justification.
